Can NRIs file income tax returns in India?
Short answer: Yes. A non-resident who earns income in India, such as rent, interest on an NRO account or capital gains, may need to file an Indian income tax return. Many NRIs also file to claim a refund of excess TDS.
India taxes non-residents only on income that is earned or received in India. Your salary from a job abroad is usually not taxable in India if you are a non-resident. Income from Indian sources usually is.
Common reasons NRIs file a return
- Rental income from property in India.
- Interest on NRO deposits, which is generally taxable. Interest on NRE accounts is generally exempt for non-residents.
- Capital gains from selling property, shares or mutual funds in India.
- To claim a refund when TDS deducted in India is more than the tax actually due.
Your residential status comes first
Whether you are resident or non-resident for a tax year depends mainly on how many days you spend in India, with special rules for Indian citizens and people of Indian origin. Your status can change from year to year, so check it each year before deciding what to declare.
NRI tax can involve double taxation agreements and foreign exchange rules. For anything beyond simple interest or rent, consider speaking to a qualified professional.
